Introduction

Welcome to Goencar Taxi ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Service") provided by Goencar Taxi, a taxi booking platform operating in Goa, India.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

Important Notice

These Terms constitute a legally binding agreement between you and Goencar Taxi. Please read them carefully. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.

1.1 Definitions

"User" or "Rider" means any person who uses the Service to book transportation services.

"Driver" or "Driver Partner" means any person who provides transportation services through our platform.

"Service" means the Goencar Taxi mobile application, website, and all related services.

"Trip" or "Ride" means a transportation service booked through our platform.

"Fare" means the amount charged for a Trip, including base fare, distance charges, time charges, and applicable fees.

"Platform Fee" means the service charge of ₹10 per ride for users and ₹50 per confirmed ride for drivers.

Terms for Users/Riders

2.1 Eligibility

You must be at least 18 years old to use our Service.
You must have the legal capacity to enter into binding contracts.
You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You must immediately notify us of any unauthorized use of your account.

2.2 Account Registration

To use our Service, you must create an account by providing:

Your full name
Valid mobile number (verified via OTP)
Email address (optional but recommended)
Profile picture (optional)

You agree to provide accurate information and to update it promptly if it changes. We reserve the right to suspend or terminate accounts with false or misleading information.

2.3 Booking a Ride

When booking a ride through our Service, you agree to:

Provide accurate pickup and destination locations
Be present at the pickup location at the scheduled time
Wait for a reasonable time (up to 5 minutes) for the driver to arrive
Treat drivers with respect and courtesy

Not request drivers to violate traffic laws
Not carry illegal substances, weapons, or prohibited items
Not smoke or consume alcohol in the vehicle
Not damage the vehicle or driver's property

2.4 Bidding System

Our platform uses a unique bidding system where:

                                        You can set your preferred price for a trip
Nearby drivers (within 5KM radius) receive your booking request
Drivers can submit competitive bids for your trip
You can review driver ratings, vehicle details, and bid amounts before accepting
Once you accept a bid, the booking is confirmed
You cannot cancel without penalty after accepting a bid

                                    

2.5 User Conduct

You agree NOT to:

Use the Service for any illegal purpose
Harass, abuse, or harm drivers or other users
Impersonate any person or entity
Interfere with or disrupt the Service

Use automated systems to book rides
Share your account with others
Leave trash or damage vehicles
Request drivers to exceed passenger capacity

Terms for Driver Partners

3.1 Driver Eligibility

To become a Driver Partner, you must:

Be at least 21 years old
Hold a valid Indian driving license (at least 2 years old)
Have valid vehicle registration documents
Have valid vehicle insurance

Have valid vehicle permit (as required)
Pass a background check and verification
Have a smartphone capable of running our app
Own or have legal authority to operate the vehicle

3.2 Vehicle Requirements

Be in good working condition
Have valid registration and insurance
Be clean and well-maintained
Have functional air conditioning (for cars)

Have working seat belts for all passengers
Meet emission standards
Not be more than 15 years old (cars) or 10 years old (motorcycles)
Have proper signage or identification

3.3 Driver Responsibilities

Provide safe, reliable, and professional services
Arrive at pickup locations on time
Follow the most efficient route
Maintain a professional appearance

Treat all riders with respect
Not discriminate against riders
Comply with all traffic laws
Report accidents or incidents immediately

3.4 Platform Fees & Payments

Platform Fee: For each confirmed ride, you agree to pay Goencar Taxi a platform fee of ₹50. This fee is deducted from your earnings before payment is processed.

Payment Schedule: Payments are processed weekly (every Monday) for rides completed in the previous week. Payments are transferred directly to your registered bank account.

Tax Responsibility: You are responsible for any taxes on your earnings. We may hold payments in case of disputes or investigations.

Booking Policy

Booking Confirmation

Confirmed when user accepts driver's bid
Both parties receive confirmation notifications
Booking details are binding once confirmed
Changes require mutual agreement

Waiting Time

Drivers must wait up to 5 minutes
After 5 minutes, cancellation allowed
Waiting time charged at ₹2 per minute
No-show fee applies after grace period

4.3 Route Changes & Multiple Stops

Route Changes

Users may request route changes during trip
Significant deviations may incur extra charges
Final fare based on actual distance

Multiple Stops

Multiple stops allowed during booking or trip
Additional stops may incur extra charges
5-minute waiting time included per stop

Payment Terms

5.1 Payment Methods

Cash

Cards

5.2 Fare Calculation

Base Fare: ₹50 (fixed charge per ride)

Distance Charge: ₹15 per kilometer (for cars)

Time Charge: ₹2 per minute (waiting time)

Platform Fee: ₹10 (charged to users)

Toll Charges: Actual toll charges (if applicable)

Night Charges: Additional ₹50 (10 PM - 6 AM)

Final fare may vary based on actual distance traveled, route taken, and waiting time. The fare shown at booking is an estimate.

5.3 Refunds

Refunds may be issued in the following cases:

Driver cancellation without valid reason
Service quality issues (verified by our team)
Technical errors in fare calculation
Duplicate charges

Refunds are processed to the original payment method. Processing time is 5-7 business days.

Cancellation Policy

User Cancellations

Before driver acceptance: No charge
After acceptance, before pickup: ₹50 fee
After driver arrives: ₹100 fee
After trip starts: Full fare applies

Driver Cancellations

Before trip starts: ₹100 penalty
After trip starts: ₹500 penalty
Repeated cancellations: Account deactivation

6.3 Valid Reasons for Cancellation (No Penalty)

Rider not found at pickup location after 5 minutes
Rider under the influence of alcohol or drugs

Rider requests illegal activities
Vehicle breakdown or emergency
Verified safety concerns

Limitation of Liability

7.1 Service Disclaimer

Goencar Taxi is a technology platform that connects users with independent driver partners. We do not provide transportation services directly. We are not a transportation carrier and do not own, operate, or control any vehicles.

7.2 Limitation of Liability

To the maximum extent permitted by law:

Goencar Taxi is not liable for any damages, injuries, or losses arising from transportation services
We are not responsible for driver conduct, vehicle condition, or trip quality
We are not liable for delays, cancellations, or route issues
Our total liability is limited to the amount you paid for the specific trip
We are not responsible for lost, stolen, or damaged personal belongings

Driver Liability

Driver Partners are independent contractors and are solely responsible for:

Vehicle maintenance and safety
Compliance with traffic laws
Insurance coverage
Any accidents or damages

User Responsibility

Users are responsible for:

Their own safety during trips
Securing personal belongings
Providing accurate information
Being present on time

Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of Goencar Taxi and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not:

Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble the Service
Remove any copyright or proprietary notices
Use our trademarks or logos without permission
Scrape or extract data from the Service

Dispute Resolution

9.1 Internal Resolution

If you have a dispute with us, a driver, or another user, you agree to first contact us at info@goencar.taxi or call us at +91 8554918603. We will attempt to resolve the dispute internally within 30 days.

9.2 Arbitration

If the dispute cannot be resolved internally, it shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India. The arbitration shall be conducted in Panaji, Goa, India, in the English language.

9.3 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of courts in Panaji, Goa, India.

Account Termination

10.1 Termination by You

You may terminate your account at any time. Upon termination:

Your access will be immediately revoked
Pending payments will be processed
Your data will be retained as required by law

10.2 Termination by Us

We may suspend or terminate your account if:

You violate these Terms
You engage in fraudulent activities
You provide false information
You receive poor ratings repeatedly

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending email notifications to registered users
Displaying in-app notifications

Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree with the modifications, you must stop using the Service and terminate your account.

The "Last Updated" date at the top of this page indicates when these Terms were last revised.

Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Goencar Taxi regarding the Service and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Agreement Acceptance

When you create an account or use our Service, you are confirming that:

You are at least 18 years of age (or the age of majority in your jurisdiction)
You have the legal capacity to enter into this agreement
You will comply with all applicable laws and regulations
All information you provide is accurate and current
You will not use the Service for any illegal or unauthorized purpose
You understand and accept the risks associated with transportation services

Note: If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
